IMPORTANT NOTICE

PLAINTA LLC IS A TECHNOLOGY PLATFORM AND DOES NOT DIRECTLY FUND ANY CASES. Plainta operates as a marketplace that connects potential plaintiffs with third-party pre-settlement funding companies. All funding decisions, terms, rates, and approvals are made solely by independent third-party funding companies, not Plainta. Plainta does not underwrite, approve, deny, or determine the terms of any funding agreement.

1. Plainta's Role as a Platform

Plainta LLC ("Plainta," "we," "us," or "our") operates exclusively as a technology platform and lead generation service. We provide a digital interface that allows individuals with pending legal claims to submit applications for pre-settlement funding consideration by third-party funding companies within our network.

Plainta does not:

  • Directly provide, offer, or extend pre-settlement funding, cash advances, or loans of any kind
  • Make any funding decisions, including approval, denial, or determination of funding amounts
  • Set, negotiate, or determine interest rates, fees, repayment terms, or any other funding conditions
  • Underwrite, evaluate, or assess the merits or value of any legal claim for funding purposes
  • Guarantee that any applicant will receive funding or any specific funding amount
  • Act as a lender, creditor, or financial institution under any federal or state law
  • Hold, manage, or disburse any funding proceeds

All funding, if approved, is provided directly by independent third-party funding companies. These companies conduct their own independent underwriting, due diligence, and approval processes. Plainta has no control over and assumes no responsibility for the decisions, actions, terms, or practices of any third-party funding company.

2. Understanding Pre-Settlement Funding

Pre-settlement funding (also known as lawsuit funding, legal funding, or litigation financing) is a NON-RECOURSE cash advance against the anticipated proceeds of a pending legal claim. It is NOT a traditional loan.

Key characteristics of pre-settlement funding:

  • Non-Recourse: Repayment is contingent solely upon successful resolution of your legal claim. If your case does not result in a monetary recovery (settlement, judgment, or award), you typically owe nothing back to the funding company.
  • Not a Loan: Because repayment is contingent on case outcome, pre-settlement funding is structured as a purchase of a portion of your potential future settlement proceeds, not as a traditional loan with guaranteed repayment obligations.
  • Risk-Based Pricing: Funding companies assume significant risk because they may receive no repayment if your case is unsuccessful. This risk is reflected in the fees, rates, and terms offered.
  • Attorney Involvement Required: You must be represented by a licensed attorney to be eligible for pre-settlement funding. Funding companies will coordinate with your attorney regarding case status and settlement proceeds.

Eligibility requirements typically include:

  • You must be 18 years of age or older
  • You must have an active, pending legal claim with monetary damages
  • You must be represented by a licensed attorney
  • Your case must meet the funding company's underwriting criteria
  • Your attorney must be willing to cooperate with the funding company's verification process

3. No Guarantees or Promises

PLAINTA MAKES NO GUARANTEES, REPRESENTATIONS, OR WARRANTIES REGARDING FUNDING APPROVAL, FUNDING AMOUNTS, TERMS, RATES, OR AVAILABILITY.

Specifically, Plainta does not guarantee:

  • That you will be approved for funding by any funding company
  • Any specific funding amount, minimum or maximum
  • Any specific interest rate, fee structure, or repayment terms
  • The timeframe for application review, approval, or funding disbursement
  • That any estimate, quote, or preliminary figure provided through our platform will be honored by any funding company
  • The outcome of your legal claim or the amount of any settlement or judgment

Any estimates, ranges, or preliminary figures displayed on our platform are for illustrative purposes only. They are generated by automated algorithms based on limited information and do not constitute offers, commitments, or guarantees of any kind. Actual funding amounts, if approved, may be significantly higher or lower than any estimate provided.

Approval decisions, funding amounts, and all terms are determined solely by third-party funding companies based on their independent underwriting criteria, which may include factors such as case type, case strength, liability assessment, damages evaluation, attorney experience, jurisdiction, and other proprietary factors not disclosed to Plainta.

4. Funding Terms, Fees, and Costs

If you are approved for funding by a third-party funding company, all terms, fees, costs, and conditions will be fully disclosed to you in writing by that funding company prior to any funding being disbursed. You are strongly encouraged to:

  • Read all funding agreements carefully and completely before signing
  • Ask questions about any terms you do not fully understand
  • Request that your attorney review any funding agreement before you sign
  • Compare offers from multiple funding companies if available
  • Understand the total cost of funding, including all fees, over the anticipated life of your case
  • Consider how funding will impact your net recovery from any settlement or judgment

Pre-settlement funding can be expensive. Fees, rates, and costs vary significantly among funding companies and may compound over time. The total amount you owe upon case resolution may be substantially more than the amount you receive. You should carefully consider whether pre-settlement funding is appropriate for your financial situation.

5. State-Specific Restrictions and Regulations

PRE-SETTLEMENT FUNDING IS NOT AVAILABLE IN ALL STATES. Significant restrictions, regulations, and limitations may apply depending on your state of residence and/or where your legal claim is pending.

Certain states have enacted laws that regulate, restrict, or prohibit pre-settlement funding transactions. These laws may impose:

  • Caps on fees, rates, or total costs
  • Mandatory disclosure requirements
  • Cooling-off or cancellation periods
  • Licensing or registration requirements for funding companies
  • Restrictions on certain case types
  • Outright prohibitions on pre-settlement funding

It is your responsibility to understand and comply with all applicable laws in your jurisdiction. Plainta does not provide legal advice regarding the legality or enforceability of pre-settlement funding in your state. Consult with your attorney or a qualified legal professional if you have questions about state-specific regulations.
